Welcome to KRUDA. These Terms of Service (“Terms”) govern your access to and use of the KRUDA website, mobile application, and related services (collectively, the “Service”). By creating an account, accessing, or using the Service, you agree to be bound by these Terms.
If you do not agree, you may not use KRUDA.
1. About KRUDA
KRUDA is a global athlete platform that enables athletes, parents, coaches, recruiters, and organizations to create profiles, share information, connect, and participate in a unified sports ecosystem. KRUDA provides tools for visibility, communication, recruiting, and athlete development.
KRUDA is not a recruiting agency, talent representative, or legal advisor.
2. Eligibility
To use KRUDA, you must:
Be at least 13 years old (or the minimum age required in your region)
Have permission from a parent or guardian if you are under 18
Use the platform in compliance with all applicable laws, including NCAA, NAIA, NFHS, and state regulations
Parents and guardians are responsible for the activity of minors under their supervision.
If you are a parent or guardian of a high school athlete, you acknowledge that your consent is required before the athlete may enter into any NIL compensation agreement through the Service.
3. User Accounts
You are responsible for:
Providing accurate information
Maintaining the confidentiality of your login credentials
All activity that occurs under your account
KRUDA may suspend or terminate accounts that violate these Terms or misuse the platform.
4. User Content
“User Content” includes any information, text, images, links, statistics, or other materials you upload or submit.
By submitting User Content, you grant KRUDA a worldwide, non‑exclusive, royalty‑free license to:
Display, process, and distribute your content within the Service
Improve platform features and functionality
Provide your content to recruiters, coaches, and organizations as intended by the platform
You retain full ownership of your content.
You agree not to upload:
Illegal content
Harassing, abusive, or harmful material
False or misleading information
Content you do not have permission to share
KRUDA may remove content that violates these rules.
5. Video Content
KRUDA does not host video uploads.
Athletes may link videos from approved third‑party platforms (e.g., YouTube, TikTok, Hudl).
You are responsible for ensuring:
You have rights to the linked content
The content complies with the third‑party platform’s terms
The content does not violate copyright or privacy laws
6. Prohibited Activities
You agree not to:
Misuse or attempt to disrupt the Service
Impersonate another person or organization
Use automated tools to scrape or extract data
Upload harmful code or attempt unauthorized access
Use KRUDA for commercial solicitation without permission
Violate NCAA, NAIA, NFHS, or state recruiting rules
Violate any applicable NIL agent registration or compliance requirements (see Section 6A)
Facilitate, post, or promote NIL deals involving the categories of products or services restricted under applicable law (see Section 6B)
KRUDA may suspend or terminate accounts that engage in prohibited activities.
6A. NIL Agent Compliance
(a) State Registration. Agents and representatives using the Service to connect with athletes for NIL opportunities must register with the applicable state authority (e.g., Louisiana Attorney General's office at nil.ag.louisiana.gov), complete any required background checks, and maintain active registration.
(b) Certification. By using the Service, agents certify that they are in compliance with all applicable state registration and disclosure requirements.
(c) Disclosure to Athletes. Agents must provide athletes with a written disclosure detailing the services to be provided, fees or compensation to be charged, and any other parties receiving compensation from the athlete's NIL activities.
(d) Penalties. KRUDA may suspend accounts, remove NIL listings, and refer violators to state authorities for non-compliance.
(e) Athlete Responsibility. Athletes are encouraged to verify their agent's registration status independently. KRUDA is not responsible for verifying agent compliance.
6B. High School NIL Marketplace Rules
(a) Parental Consent. High school athletes under 18 must obtain written parental or guardian consent before entering into any NIL agreement through the Service.
(b) Restricted Categories. NIL deals involving alcohol, cannabis, gambling, tobacco, weapons, adult content, or any other categories prohibited by applicable law are not permitted on the platform.
(c) School Restrictions. Athletes must comply with their school's policies regarding NIL activities during school hours, team activities, and school events.
(d) No School Property. Athletes may not use school facilities, uniforms, or logos in NIL content without express permission from their school.
7. Sponsorships and Financial Assistance
KRUDA may offer sponsorships or financial assistance programs to users who qualify.
Participation in these programs is optional and subject to additional terms.
KRUDA does not guarantee sponsorship approval or financial outcomes.
Businesses using the NIL marketplace are responsible for ensuring their NIL deals comply with applicable College Sports Commission (CSC) guidelines, including any determinations regarding Associated Entity status under the House v. NCAA settlement or similar regulatory frameworks.
8. Payments and Subscriptions
Some features may require payment or subscription.
By purchasing a paid feature, you agree to:
Provide accurate billing information
Allow KRUDA or its payment partners to process charges
Comply with any additional terms presented at checkout
All fees are non‑refundable unless required by law.
9. Privacy
Your use of KRUDA is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.
You must review the Privacy Policy before using the Service.
10. Third‑Party Services
KRUDA may integrate with third‑party platforms such as:
TikTok
YouTube
Hudl
Social media platforms
Recruiting tools
Your use of third‑party services is governed by their respective terms and policies.
KRUDA is not responsible for third‑party content or actions.
11. Intellectual Property
All KRUDA trademarks, branding, logos, software, and design elements are owned by KRUDA and protected by law.
You may not:
Copy
Modify
Distribute
Reverse engineer
Create derivative works
…based on any part of the Service.
12. Disclaimers
KRUDA is provided “as is” and “as available” without warranties of any kind.
We do not guarantee:
Recruiting outcomes
Scholarship offers
Exposure or visibility
Platform uptime or error‑free operation
NIL deal outcomes or financial results
You use the Service at your own risk.
13. Limitation of Liability
To the fullest extent permitted by law, KRUDA is not liable for:
Loss of data
Loss of opportunities
Financial losses
Damages resulting from use or inability to use the Service
Actions taken by third parties, agents, including recruiters or organizations
Violations of state law by users, including unregistered agent activity or noncompliant NIL deals
Some jurisdictions do not allow certain limitations, so these may not apply to you.
14. Changes to the Service
KRUDA may update, modify, or discontinue features at any time.
We may also update these Terms periodically.
Continued use of the Service means you accept the updated Terms.
15. Termination
KRUDA may suspend or terminate your account if:
You violate these Terms
You misuse the platform
You engage in harmful or illegal behavior
including failure to comply with applicable state NIL agent registration requirements or high school NIL rules
You may stop using the Service at any time.
16. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict‑of‑law principles.
